Le 5 avril 2019 l’OMC a distribué le rapport du Groupe spécial chargé d’examiner l’affaire introduite par l’Ukraine “Russie - Mesures concernant le trafic en transit” (DS512).
Canada - Term of Patent Protection
On 6 May 1999 the US requested consultations with Canada in respect of the term of protection granted to patents that were filed in Canada before 1 October 1989. The US contended that the TRIPS Agreement obligates Members to grant a term of protection for patents that runs at least until twenty years after the filing date of the underlying protection and requires each Member to grant this minimum term to all patents existing as of the date of the application of the Agreement to that Member. The US alleged that under the Canadian Patent Act the term granted to patents issued on the basis of applications filed before 1 October 1989 is 17 years from the date on which the patent is issued. The US contended that this situation is inconsistent with Articles 33 65 and 70 of the TRIPS Agreement.
Brazil - Export Financing Programme for Aircraft
On 19 June 1996 Canada requested consultations with Brazil under Article 4 of the SCM Agreement which provides for special procedures for export subsidies. Canada claimed that export subsidies granted under the Brazilian Programa de Financiamento às Exportações (PROEX) to foreign purchasers of Brazil’s Embraer aircraft are inconsistent with Articles 3 27.4 and 27.5 of the SCM Agreement.

États-Unis - Mesures antidumping et mesures compensatoires visant les gros lave linge à usage domestique en provenance de Corée
Le 13 avril 2017 un arbitre a publié sa décision au sujet du “délai raisonnable” pour la mise en oeuvre des recommandations et décisions de l’Organe de règlement des différends (ORD) dans l’affaire “États-Unis — Mesures antidumping et mesures compensatoires visant les gros lave-linge à usage domestique en provenance de Corée” (WT/DS464). L’arbitre a déterminé que le “délai raisonnable” imparti aux États-Unis pour mettre en oeuvre les recommandations et décisions de l’ORD dans ce différend serait de 15 mois à compter de l’adoption des rapports du Groupe spécial et de l’Organe d’appel dans cette affaire. Le délai résonnable viendra donc à expiration le 26 décembre 2017.

L’OMC a publié le 3 avril 2006 le rapport du Groupe spécial dans l’affaire États-Unis — Détermination finale de l’existence d’un dumping concernant les bois d’oeuvre résineux en provenance du Canada — Recours du Canada à l’article 21:5 du Mémorandum d’accord sur le règlement des différends.

European Communities - Measures Prohibiting the Importation and Marketing of Seal Products
On 2 November 2009 Canada requested consultations with the European Communities concerning Regulation (EC) No. 1007/2009 of the European Parliament and of the EC Council of 16 September 2009 on trade in seal products and subsequent related measures. According to Canada the regulation in question prohibits the importation and the placing on the EC market of all seal products.

Canada - Measures Affecting the Export of Civilian Aircraft
On 10 March 1997 Brazil requested consultations with Canada in respect of certain subsidies granted by the Government of Canada or its provinces intended to support the export of civilian aircraft. The request was made pursuant to Article 4 of the SCM Agreement. Brazil contended that these measures are inconsistent with Article 3 of the SCM Agreement.

United States - Preliminary Determinations with Respect to Certain Softwood Lumber from Canada
On 21 August 2001 Canada requested consultations with the US concerning the preliminary countervailing duty determination and the preliminary critical circumstances determination made by the US Department of Commerce on 9 August 2001 with respect to certain softwood lumber from Canada. This request also concerned US measures on company-specific expedited reviews and administrative reviews. In particular: As far as the preliminary countervailing duty determination is concerned Canada considered this determination to be inconsistent with US obligations under Articles 1 2 10 14 17.1 17.5 19.4 and 32.1 of the SCM Agreement and Article VI(3) of GATT 1994. With respect to the preliminary critical circumstances determination Canada considered this determination to be inconsistent with Articles 17.1 17.3 17.4 19.4 and 20.6 of the SCM Agreement. As regards US measures on company-specific expedited reviews and administrative reviews Canada considered these measures are inconsistent with US obligations under Article VI:3 of the GATT 1994 and Articles 10 19.3 19.4 21.1 21.2 and 32.1 of the SCM Agreement. Canada also considered that the US had failed to ensure that its laws and regulations are in conformity with its WTO obligations as required by Article 32.5 of the SCM Agreement and Article XVI:4 of the WTO Agreement. On the grounds that the affirmative preliminary countervailing duty and critical circumstances determinations had an immediate and significant trade impact Canada requested urgent consultations pursuant to Article 4.8 of the DSU. Although accepting Canada’s request to enter into consultations the US did not accept this to be a case of urgency for the purposes of Article 4.8 of the DSU since the measures in question involve the posting of bond for or deposit of preliminary duties which could be refunded in whole or in part.

On 25 April 2017 the WTO issued the panel report in the case brought by Canada in “China - Anti-Dumping Measures on Imports of Cellulose Pulp from Canada".
United States - Final Countervailing Duty Determination with Respect to Certain Softwood Lumber from Canada
On 3 May 2002 Canada requested consultations with the United States. The request concerned the final affirmative countervailing duty determination by the US Department of Commerce (File No. C‑122839) issued on 25 March 2002 with respect to certain softwood lumber from Canada. The measures at issue include the initiation and conduct of the investigation the final determination provision of expedited reviews and other matters related to these measures. Canada contended that these measures were inconsistent with and violate the United States’ obligations under Articles 1 2 10 11 12 14 15 19 22 and 32.1 of the SCM Agreement and Articles VI:3 and X:3 of the GATT 1994.

United States - Certain Country of Origin Labelling (Cool) Requirements - Recourse 1
On 1 December 2008 Canada requested consultations with the United States concerning certain mandatory country of origin labelling (COOL) provisions in the Agricultural Marketing Act of 1946 as amended by the 2008 Farm Bill and as implemented through an Interim Final Rule of 28 July 2008. These include the obligation to inform consumers at the retail level of the country of origin in respect of covered commodities including beef and pork. The eligibility for a designation of a covered commodity as exclusively having a US origin can only be derived from an animal that was exclusively born raised and slaughtered in the United States. This would exclude such a designation in respect of beef or pork derived from livestock that is exported to the United States for feed or immediate slaughter.

Canada - Export Credits and Loan Guarantees for Regional Aircraft
On 22 January 2001 Brazil requested consultations with Canada concerning subsidies which are allegedly being granted to Canada’s regional aircraft industry. Brazil’s claims are as follows: Export credits within the meaning of Item (k) of Annex I to the SCM Agreement are being provided to Canada’s regional aircraft industry by the Export Development Corporation (EDC) and the Canada Account. Loan guarantees within the meaning of Item (j) of Annex I to the SCM Agreement are being provided by EDC Industry Canada and the Province of Quebec to support exports of Canada’s regional aircraft industry. Brazil takes the view that all of the above-mentioned measures are subsidies within the meaning of Article 1 of the SCM Agreement since they are financial contributions that confer a benefit. According to Brazil they are also contingent in law or in fact upon export and constitute therefore a violation of Article 3 of the SCM Agreement.

European Communities - Trade Description of Scallops (Request by Canada)
The complaint concerned a French Government Order laying down the official name and trade description of scallops. Complainants claimed that this Order will reduce competitiveness on the French market as their product will no longer be able to be sold as “Coquille Saint-Jacques” although there is no difference between their scallops and French scallops in terms of colour size texture appearance and use i.e. it is claimed they are “like products”. Violations of GATT Articles I and III and TBT Article 2 were alleged.

European Communities - Measures Concerning Meat and Meat Products (Hormones)
On 28 June 1996 Canada requested consultations with the European Communities regarding the importation of livestock and meat from livestock that have been treated with certain substances having a hormonal action under Article XXII of the GATT 1994 and the corresponding provisions in the SPS Agreement TBT Agreement and the Agreement on Agriculture. Canada alleges violation of Articles 2 3 and 5 of the SPS Agreement; Article III or XI of the GATT 1994; Article 2 of the TBT Agreement; and Article 4 of the Agreement on Agriculture.
Australia - Measures Affecting Importation of Salmon
On 5 October 1995 Canada requested consultations with Australia in respect of Australia’s prohibition of imports of salmon from Canada based on a quarantine regulation. Canada alleged that the prohibition is inconsistent with Articles XI and XIII of the GATT 1994 and also inconsistent with the SPS Agreement.
Canada - Measures Affecting the Importation of Milk and the Exportation of Dairy Products
On 8 October 1997 the United States requested consultations with Canada in respect of export subsidies allegedly granted by Canada on dairy products and the administration by Canada of the tariff-rate quota on milk. The United States contended that these export subsidies by Canada distort markets for dairy products and adversely affect US sales of dairy products. The United States alleged violations of Articles II X and X1 of the GATT 1994 Articles 3 4 8 9 and 10 of the Agreement on Agriculture Article 3 of the SCM Agreement and Articles 1 2 and 3 of the Import Licensing Agreement.

On 1 November 2019 a WTO arbitrator issued its decision on the level of countermeasures China may request with respect to the United States in “United States - Certain Methodologies and their Application to Anti-Dumping Proceedings Involving China” (DS471).
European Communities - Measures Affecting Asbestos and Asbestos – Containing Products
On 28 May 1998 Canada requested consultations with the EC in respect of measures imposed by France in particular Decree of 24 December 1996 with respect to the prohibition of asbestos and products containing asbestos including a ban on imports of such goods. Canada alleged that these measures violate Articles 2 3 and 5 of the SPS Agreement Article 2 of the TBT Agreement and Articles III XI and XIII of GATT 1994. Canada also alleged nullification and impairment of benefits accruing to it under the various agreements cited.
