On 17 December 2002, the United States requested consultations with Canada as regards matters concerning the export of wheat by the Canadian Wheat Board and the treatment accorded by Canada to grain imported into Canada. According to the United States, the actions of the Government of Canada and the Canadian Wheat Board (entity enjoying exclusive rights to purchase and sell Western Canadian wheat for human consumption) related to export of wheat appear to be inconsistent with paragraphs 1(a) and 1(b) of Article XVII of GATT 1994.

On 27 July 2021 he WTO circulated the panel report in the case brought by Tunisia in “Morocco — Definitive Anti-Dumping Measures on School Exercise Books from Tunisia” (DS578).

El 18 de abril de 2019 la OMC distribuyó el informe del Grupo Especial encargado de examinar el asunto planteado por los Estados Unidos en la diferencia “China - Contingentes arancelarios aplicables a determinados productos agropecuarios” (DS517).

El 2 de diciembre de 2019, la OMC distribuyó el informe del Grupo Especial sobre el cumplimiento en la diferencia “Comunidades Europeas y determinados Estados miembros - Medidas que afectan al comercio de grandes aeronaves civiles - Recurso de la UE al párrafo 5 del artículo 21 del ESD” (DS316), planteada por la Unión Europea.

On 13 September 2002, Canada requested consultations under Article 4.8 of the DSU (urgency procedure) with the United States concerning the final affirmative determination of sales at less than fair value (dumping) with respect to certain softwood lumber products from Canada (Inv. No. A-122-838) announced by the US Department of Commerce (USDOC) on 21 March 2002 pursuant to Section 735 of the Tariff Act of 1930, as amended on 22 May 2002 (Final Determination). The measures at issue include the initiation of the investigation, the conduct of the investigation and the Final Determination. Canada considered these measures and, in particular, the determinations made and methodologies adopted therein by the DOC under authority of the United States Tariff Act of 1930, to violate Articles 1, 2.1, 2.2, 2.4, 2.6, 5.1, 5.2, 5.3, 5.4, 5.8, 6.1, 6.2, 6.4, 6.9 and 9.3 of the Anti-Dumping Agreement and Articles VI and X:3(a) of the GATT 1994.

On 28 February 2019 the WTO circulated the panel report in the case brought by the United States in “China — Domestic Support for Agricultural Producers” (DS511)

El 25 de abril de 2017, la OMC hizo público el informe del Grupo especial sobre el caso “China - Medidas antidumping relativas a las importaciones de pasta de celulosa procedentes del Canadá”.

On 5 October 1995, Canada requested consultations with Australia in respect of Australia’s prohibition of imports of salmon from Canada based on a quarantine regulation. Canada alleged that the prohibition is inconsistent with Articles XI and XIII of the GATT 1994, and also inconsistent with the SPS Agreement.

On 11 July 2019 the WTO circulated two panel report in the cases brought by the United States in “Canada — Additional Duties on Certain Products from the United States” (DS557) and “Mexico — Additional Duties on Certain Products from the United States” (DS560).

Le 17 mars 2000, l’OMC a publié le rapport du Groupe spécial dans l’affaire “Canada - Protection conférée par un brevet pour les produits pharmaceutiques”.

L’Organe d’appel a publié, le 13 avril 2006, son rapport concernant le rapport du groupe spécial de la mise en conformité dans l’affaire “Etats-Unis — Enquête de la Commission du commerce international dans l’affaire concernant certains bois d’oeuvre résineux en provenance du Canada” (DS277).

L’OMC a publié, le 17 février 2003, le rapport d’arbitrage concernant l’affaire “Canada - Crédits à l’exportation et garanties de prêts accordés pour les aéronefs régionaux”.

El 18 de noviembre de 2011, la OMC publicó el informe del Grupo Especial que había examinado las reclamaciones del Canadá y México, respectivamente, con respecto al asunto “Estados Unidos — Determinadas prescripciones en materia de etiquetado indicativo del país de origen (EPO)” (DS384 y DS386).

On 3 July 1998, Japan requested consultations with Canada in respect of measures being taken by Canada in the automotive industry. Japan contended that under Canadian legislation implementing an automotive products agreement (Auto Pact) between the US and Canada, only a limited number of motor vehicle manufacturers are eligible to import vehicles into Canada duty free and to distribute the motor vehicles in Canada at the wholesale and retail distribution levels. Japan further contended that this duty-free treatment is contingent on two requirements: Canadian value-added (CVA) content requirement that applies to both goods and services; and manufacturing and sales requirement. Japan alleges that these measures are inconsistent with Articles I:1, III:4 and XXIV of GATT 1994, Article 2 of the TRIMs Agreement, Article 3 of the SCM Agreement, and Articles II, VI and XVII of GATS.

On 20 December 2002, Canada requested consultations with the United States regarding the investigation of the USITC in Softwood Lumber from Canada (Invs. Nos. 701-TA-414 and 731-TA-928 (Final)) and the final definitive anti-dumping and countervailing duties applied as a result of the USITC’s final determination made on 2 May 2002, notice of which was published in the United States Federal Register on 22 May 2002 (Volume 67, Number 99 at pp. 36022-36023) that an industry in the United States is threatened with material injury by reason of imports of softwood lumber from Canada that the Department of Commerce has determined are subsidized and sold in the United States at less than fair value. Canada claimed that, through these measures, the United States has violated its obligations under Article VI:6(a) of the GATT 1994, Articles 1, 3.1, 3.2, 3.3, 3.4, 3.5, 3.7, 3.8, 12 and 18.1 of the Anti-Dumping Agreement and Articles 10, 15.1, 15.2, 15.3, 15.4, 15.5, 15.7, 15.8, 22 and 32.1 of the SCM Agreement.

On 28 June 2018 the WTO circulated the panel report in the cases brought by Honduras, the Dominican Republic, Cuba and Indonesia in “Australia — Certain Measures Concerning Trademarks, Geographical Indications and Other Plain Packaging Requirements Applicable to Tobacco Products and Packaging.

El 29 de agosto de 2003, la OMC hizo público el informe del Grupo especial sobre el caso “Estados Unidos - Determinación definitiva en materia derechos compensatorios con respecto a determinada madera blanda procedente del Canadá”.

El 28 de junio de 2014 la OMC distribuyó el informe del Grupo Especial en los asuntos planteados por Honduras, la República Dominicana, Cuba e Indonesia “Australia — determinadas medidas relativas a las marcas de fábrica o de comercio, indicaciones geográficas y otras prescripciones de empaquetado genérico aplicables a los productos de tabaco y al empaquetado de esos productos” (DS435, DS441, DS458 y DS467)

Le 22 mai 2014, l’Organe d’appel de l’OMC a remis ses rapports dans l’affaire “Communautés européennes — Mesures prohibant l’importation et la commercialisation de produits dérivés du phoque (DS400 / DS401)”.
