Trade Policy Review: Guatemala 2009
“Trade Policy Reviews” analyse the trade policies and practices of each member of the WTO. The reviews consist of three parts: an independent report by the WTO Secretariat, a report by the government, and the concluding remarks by the Chair of the WTO’s Trade Policy Review Body. The opening section - “key trade facts” - provides a visual overview of the WTO member’s major exports/imports, main export destinations, origins for its imports and other key data. Trade Policy Review: Guatemala 2025
The fourth review of the trade policies and practices of Guatemala takes place on 12 and 14 November 2025. The basis for the review is a report by the WTO Secretariat and a report by the Government of Guatemala.
Report by Guatemala
During the review period, Guatemala’s trade policy has continued to encourage trade liberalization through the conclusion of international trade agreements and the adoption of various trade facilitation measures.
Concluding remarks by the Chairperson of the Trade Policy Review Body
This third Trade Policy Review of Guatemala has provided us with the opportunity to better understand Guatemala’s trade and investment policies, as well as the changes introduced to them since the last Review in 2009. I would like to thank Minister Morales, Ambassador Sperisen and the rest of the Guatemalan delegation for their constructive engagement throughout this exercise. I would also like to thank our discussant, Ambassador Aguirre, for his comprehensive and thought-provoking remarks, as well as the 23 delegations which have taken the floor, for their active participation.
Report by the WTO Secretariat
During the period under review, Guatemala intensified its trade liberalization and economic reform efforts. An important step in this process was the elimination, at the beginning of 2016, of the export performance requirements for production under the free-zone and maquila regimes. At the same time, Guatemala updated its government procurement legislation to ensure greater transparency and efficiency, as well as its legislation governing certain aspects of intellectual property rights protection, and took steps to facilitate trade. A number of challenges remain, however, particularly in the competition policy area, where no legislation has yet been implemented.

The Trade Policy Review Mechanism (TPRM) was first established on a trial basis by the GATT CONTRACTING PARTIES in April 1989. The Mechanism became a permanent feature of the World Trade Organization under the Marrakesh Agreement which established the WTO in January 1995.

Mexico - Additional Duties on Certain Products from the United State
On 11 July 2019 the WTO circulated two panel report in the cases brought by the United States in “Canada — Additional Duties on Certain Products from the United States” (DS557) and “Mexico — Additional Duties on Certain Products from the United States” (DS560).

Mexico - Anti-Dumping Duties on Steel Pipes and Tubes from Guatemala
On 17 June 2005, Guatemala requested consultations with Mexico concerning the definitive anti-dumping duties imposed by Mexico against imports of steel pipes and tubes from Guatemala and the investigation leading thereto. According to Guatemala, the anti-dumping duties concerned and the investigation leading thereto are inconsistent with Mexico’s obligations
Peru - Additional Duty on Imports of Certain Agricultural Products
On 12 April 2013, Guatemala requested consultations with Peru with respect to the imposition by Peru of an “additional duty” on imports of certain agricultural products, such as rice, sugar, maize, milk and certain dairy products. Guatemala claims that the measure at issue is inconsistent with: - Article 4.2 and footnote 1 of the Agreement on Agriculture; - Articles II:1(a), II:1(b), X:1, X:3(a), XI and XI:1 of the GATT 1994; and - Articles 1, 2, 3, 5, 6 and 7 of the Customs Valuation Agreement.

Le 20 juillet 2015, l’Organe d’appel de l’OMC a remis son rapport dans l’affaire “Pérou — Droit additionnel visant les importations de certains produits agricoles” (DS457) soumise par le Guatemala.

On 09 April 1999, the WTO issued the dispute panel reports in the case "European communities - Regime for the importation, sale and distribution of bananas".

Guatemala - Anti-Dumping Investigation Regarding Portland Cement from Mexico
On 15 October 1996, Mexico requested consultations with Guatemala in respect of an anti-dumping investigation commenced by Guatemala with regard to imports of portland cement from Mexico. Mexico alleged that this investigation was in violation of Guatemala’s obligations under Articles 2, 3, 5 and 7.1 of the Anti-Dumping Agreement.

Guatemala - Definitive Anti-Dumping Measures on Grey Portland Cement from Mexico
On 5 January 1999, Mexico requested consultations with Guatemala concerning definitive anti-dumping duties imposed by the authorities of Guatemala on imports of grey Portland cement from Mexico and the proceedings leading thereto. Mexico alleged that the definitive anti-dumping measure is inconsistent with Articles 1, 2, 3, 5, 6, 7, 12 and 18 of the Anti-Dumping Agreement and its Annexes I and II, as well as with Article VI of the GATT 1994.
